This privacy notice gives you information about how we collect, use and process your personal data through your use of the websites (including egoista.app), applications (including the Egoista mobile app), tools and/or platforms of Egoista Ltd (collectively, our “Platform”).​  In this context, Egoista Ltd (referred to as "Egoista", "we", "us" or "our" in this privacy notice) will generally act as the controller and responsible for your personal data, as we decide why and how your personal data is processed.  Our Platform is not intended for children and we do not knowingly collect data relating to children.  Please read this privacy notice carefully to understand how we handle personal data about you that we collect and how we use that personal data.

If you are a legal person, you undertake and guarantee to process personal data and supply such personal data to us in compliance with any applicable data protection legislation (including, but not limited to the UK General Data Protection Regulation and the Data Protection Act 2018) (collectively, "Data Protection Legislations"), including informing the data subjects to whom personal data you provide to us relate of the contents of this privacy notice.

What Personal Data We Collect and Use

Personal data means any information relating to an identified or identifiable natural person.  We may collect, use or otherwise process personal data about you, including:

  • basic identification information, such as name, title, position, company name, email address, postal address, and phone number;

  • billing information, such as your credit card information, payment information and other data relating to payment in relation to your membership;

  • membership account information that you provided on our Platform when you create your account with us;

  • marketing and communications information, such as your preferences in receiving marketing from us and our third parties and your communication preferences;

  • technical data, such as your IP address, the domain of your internet service provider, the type and version of your browser, your operating system and platform, and information regarding your interactions with our Platform; and

  • any additional information you voluntarily provide (for example, by filling in a form or registering for newsletters).

This information may either be directly provided by you or by a legal entity for whom you work (for example if you are the contact person designated by a salon to manage the commercial relations with us).

If you provide us with sensitive personal data (as such term is defined under Data Protection Legislations) or we obtain it from a third party, we will process such sensitive personal data only as permitted under applicable laws and where we have established a legal basis for such processing.  For instance, it may be possible for us to process sensitive personal data where it is necessary for the establishment, exercise or defence of legal claims, or with explicit consent, or for reasons of substantial public interest, or where processing of sensitive personal data is otherwise authorised by applicable laws or regulations.

How We Collect Your Personal Data 

We may collect your personal data whenever:

  • you visit and browse our Platform;

  • you contact us via our contact channels;

  • you subscribe to our newsletter;

  • you sign up and create an account with us (including becoming a member of Egoista);

  • you provide information to us via our forms;

  • we interact with you as a prospective or existing member or supplier and you provide us with your personal data; and/or

  • we interact with you as representatives or contact persons of a prospective or existing member or supplier that are legal entities.

You are not subject to any legal obligation to provide your personal data to us.  However, access to and use of certain services provided by us may not be able to commence or continue if you do not provide the necessary personal data.  For example, we will not be able to communicate with you or send you newsletters without your contact details, and we will not be able to set up your membership account without your email address.

Purpose and Legal Basis of the Processing

Depending on how you choose to interact with us, we or processors acting on our behalf may process your personal data for one or more of the purposes detailed below:

  1. Providing our services (including undertaking sales and procurement activities, managing our services, tracking our activities and interactions with you, and registering users);

  2. Communications with you (including communicating with you in response to a request received from you, sending you our newsletters, communications and updates, marketing our products and services, receiving responses from you and measuring interest in our products and services);

  3. Compliance with security and other policies and regulations;

  4. Compliance with applicable law; and/or

  5. Selling our business to a third party or attracting investment in our business.

We may process your personal data for our or a third party's legitimate interests, to comply with the legal obligations imposed on us, or to perform any pre-contractual measures as well as the contract entered into by the data subjects.  Where the legal basis relied upon are our or a third party's legitimate interests, personal data will only be processed if it does not unduly affect your interests or fundamental rights and freedoms.  In addition, in limited circumstances, we may occasionally ask for consent for specific activities (including where you consent to receiving newsletter, communications and updates by subscribing on our website).

Several of the purposes for processing outline above may overlap and there may be several purposes which justify our use of your personal data.  Where required by applicable law, we will only use your personal data for the purposes for which we have collected it, unless we reasonable consider that we need to use it for another reason and that reason is compatible with the original purpose for such collection.

You can ask to stop sending you marketing communications at any time by following the opt-out links within any marketing communication sent to you or by contacting us (as further detailed below in the "Contact Us" section).  If you opt out of receiving marketing communications, you will still receive service-related communications that are essential for administrative or customer service purposes.

In the context of the above mentioned purposes, we may disclose your personal data to other data recipients, which include the following categories of recipients: other service providers, agents, contractors, consultants, professional advisers, lenders, data processors, law enforcement agencies and governmental or public agencies or authorities, parties to disputes and persons employed and/or retained by the aforementioned.  In addition, your personal data may also be disclosed to any third party to whom we assign or novate or otherwise transfer any of our rights or obligations to, or to whom we sell or approach to attract investment in our business.

  • request the erasure of your personal data in certain circumstances, such as where we collect your personal data on the basis of your consent and you withdraw your consent;

  • request for restriction of the use of your personal data in certain circumstances, such as while we consider another request that you have submitted, for example a request that we update your personal data;

  • request for a copy of your personal data to be provided to you or another party in a structured, commonly used and machine readable format in certain circumstances; and

  • in limited circumstances where our processing of your personal data is based on your consent, to withdraw your consent, although please note that withdrawal of consent (i) does not invalidate the consent-based processing that occurred prior to such withdrawal or processing that is not based on consent, and (ii) means that we will no longer be able to perform such consent-based processing activities, and may result in us being unable to provide certain services to you.
